"Because Kellyanne Conway is a presidential appointee, the Office of Special Counsel itself does not have authority to discipline her", said Daniel Jacobson, who worked at the White House Counsel's Office under President Obama advising on ethics and compliance matters.

"Given that Ms. Conway is a repeat offender and has shown disregard for the law, OSC recommends that she be removed from federal service". While the president and vice president are exempt from the Hatch Act, that privilege does not extend to federal employees.

Yet, Press Secretary Sarah Huckabee Sanders and other Trump officials have stood at the White House podium - when daily or regular press briefings were held - and declined to answer questions by pointing to the Hatch Act.

The OSC probe into Conway's comments and behavior came in response to a pair of complaints filed by Citizens for Responsibility and Ethics in Washington (CREW) in October 2018 and May 2019. She is an adviser to the president, but her main role is to speak for the president on political issues.

"He added, "[OCS's] decisions seem to be influenced by media pressure and liberal organizations, and perhaps OSC should be mindful of its own mandate to act in a fair, impartial, nonpolitical manner, and not misinterpret or weaponize the Hatch Act". Although it does not appear Conway is about to suffer any consequences of her statements, if she did, she could challenge that ruling again, now decades later.

The Office of Special Counsel is not the same as the Justice Department special counsel.

The Hatch Act bars government employees from making statements for or against political candidates.

Cipollone also faulted the OSC for potentially violating Conway's due process rights by failing to notify her about the specific allegations in the report and allow her to respond to each item.

Mr. Cipollone said in his letter to the OSC this week that there aren't binding rules on how social media accounts can be used. When Mrs. Conway was referring to them, he said, she was generally talking about their policies.

The OSC report itself stated that in one February 19 interview on "Fox & Friends", Conway "insinuated that Senator Booker was "sexist" and a "tinny" "motivational speaker, '" and claimed Sen".

According to the complaint, Solis "left a voicemail message on a subordinate employee's government-issued Blackberry in which you asked the employee to contribute toward and assist with organizing others to attend a fundraiser for the President's reelection campaign".

On November 20, in an appearance on "Fox and Friends", Conway said this about Democrat Doug Jones: "Doug Jones in Alabama, folks, don't be fooled".
