Australia's security agencies are in a "race against time" to perform background checks on asylum seekers after new medical evacuation laws cleared parliament.

The 75-74 vote - which came on the first sitting day of parliament this year - is a blow to the already embattled prime minister and raised questions about whether he can remain in office.

Labor also pushed back the decision time from 24 hours to 72 hours in response to ASIO's concerns it would not be able to conduct a security assessment within that shortened period.

"The opening of Christmas Island, I believe, was a political gesture created to fuel domestic political unrest but I'm anxious that we'll have tragic consequences because this is a government addicted to slogans and fear", he added.

Morrison lost his parliamentary majority a year ago and has been relying on cross-benchers to keep control of the lower House of Representatives.

The vote drew cheers from asylum-seeker activists in parliament's public gallery but the upper house must approve the bill before it becomes law, so the defeat, though damaging for the government, does not trigger an immediate election. The Christmas Island center has been described as a high-security prison where the unlucky "boaters" are forced to cohabitate with hardened criminals, including rapists.

The new law states that those who are transferred must be in detention but Labor argues this continues to allow the Immigration Minister to release them into community detention.

Despite dire warnings about the health of offshore detainees from groups like Doctors Without Borders, the Coalition government has been reluctant to permit too many medical transfers.

"This legislation is confined to the current cohort of people on Manus Island and Nauru", said Kerryn Phelps, an independent lawmaker. "You can't underplay the impact that a spark of hope will have when people are desperate".
