Netflix Being Sued Over 'Black Mirror: Bandersnatch'

Black Mirror: Bandersnatch is available to stream on Netflix. The popular book series sent children on many fantastical adventures, like time travel through space or in search of the abominable snowman.

TMZ reports the streaming giant has been hit with a $25M lawsuit by the creators of "Choose Your Own Adventure" over the latest installment in the Black Mirror series.

In "Bandersnatch", viewers control the fate of a computer programmer who's creating a video game based on a fantasy novel titled Bandersnatch.

Bandersnatch, which debuted last month, is a technically-ambitious feat, allowing viewers to direct the main character's actions and decisions and choose the path that his story will ultimately take. The movie was billed as a "choose your own adventure" tale, even though the company largely refrained from actually using that phrase in the marketing.

Chooseco printed over 620,000 copies of its Choose Your Own Adventure series for distribution across the nation previous year, according to the lawsuit.

"The misappropriation of our mark by Netflix presents an extreme challenge for a small independent publisher like Chooseco", said Shannon Gilligan, widow of Choose Your Own Adventure creator R.A. Montgomery, in a statement.

According to a January 11th, 2019 Hollywood Reporter story, US -based publisher Chooseco filed documents in Vermont arguing that the publisher has used the phrase since the 1980s and has sold more than 265 million copies of its Choose Your Own Adventure books.

Chooseco, which has owned the trademark since the 1980s, is claiming infringement, dilution and unfair competition and demanding at least $US25 million ($35 million) in damages or Netflix's profits, whichever is greater. The suit also claims that the themes tarnish the "Choose Your Own Adventure" brand.

The company had already partnered with Twentieth Century Fox for an upcoming series of interactive films based on the books, which have sold over 265m copies worldwide.

A Netflix spokesperson declined to comment.
