U.S. soothes Indian H-1B concerns

McClatchy DC reported on December 31 that USCIS planned to reinterpret current law in a way that would stop H-1B workers from extending their status while awaiting final adjudication of their green card applications.

Coming as a relief for many Indian workers in the United States is the latest announcement by the Trump administration which clarifies that the government is not considering a policy change that could force the workers on H-1B visa to leave the country.

This issue that Trump administration was considering potential policy changes to H-1B visa extensions that would trigger "self-deportation" of hundreds of thousands Indian tech workers generated a swift and intense blowback from some lawmakers and the IT industry.

This provides for H-1B extensions beyond the six-year cap that is prevailing now.

USCIS has now told McClatchy that while it will conduct a thorough review of employment-based visas, it has no plans to make a regulatory change that would reinterpret the H-1B extension provisions of AC21.

India's National Association of Software & Services Companies (NASSCOM) has repeatedly cautioned against any disruption to the H-1B program, saying that it would have detrimental effects on both the U.S. and India; nevertheless, it remains to be seen how President Trump's "America First" approach and current antipathy towards further immigration might eventually impact on overseas tech workers and their employers.
