Kenya's judges condemn 'savage' intimidation following election ruling

"The presidential election was not conducted in accordance with the constitution, rendering the declared results invalid, null and void", Chief Justice David Maraga said during the court proceeding.

Maraga in his brief ruling almost three weeks ago mentioned only "irregularities and illegalities" in the transmission of vote results, when he annulled Kenyatta's victory over his rival Raila Odinga.

A section of the protesters demanded for President Kenyatta to be sworn in as the president while others called for recounting of the presidential poll votes, accusing the Supreme Court of "stealing" Jubilee's win in the historic judgement delivered on September 1.

Police in Kenya have used tear gas to disperse protesters angry at a Supreme Court ruling which invalidated President Uhuru Kenyatta's re-election in August 8 votes.

Mr Maraga and three other justices ruled four to two to annul Mr Kenyatta's re-election and call for a new election, which is set for October 17.

Kenya opposition National Super Alliance (Nasa) legislators have claimed that a French IT firm that supplied election kits paid a Ksh200 million ($1.9m) bribe to a senior government official and an electoral commission official to win the contract to supply the Kenya Integrated Election Management (KIEMs) kits.

"JSC notes with dismay that the Inspector-General of Police, who is expected to provide security to all government facilities, has repeatedly ignored calls to act, exposing judicial officers, property and litigants to danger", he said.

National police spokesman George Kinoti said he would await further details of the chief justice's criticism before responding, Reuters news agency reports.

Mr Kenyatta has called the Supreme Court judges "crooks" and warned of unspecified action against the judiciary if he is re-elected next month.

Kenya's election commission initially declared Mr Kenyatta, 55, the victor by a margin of 1.4 million votes but the result was immediately challenged in court by his nearest rival, opposition leader Raila Odinga.

Kenya's chief justice on Tuesday hit out at political leaders and their supporters over a wave of threats against his court, which annulled last month's presidential election over widespread irregularities.

The statement raises more questions over whether the new election will be held on time.

Opposition leader Raila Odinga has launched a full-throttled campaign for the sacking of electoral commission officials whom it blames for bungling the election.

He also wants OT-Morpho blacklisted and investigated for alleged complicity in electoral fraud.

But in a statement, OT-Morpho cautioned that it was unable to deploy the same equipment that was used on August 8.

OT-Morpho said it had conducted two separate independent audits that verified there was no infiltration or piracy.
